Supreme Court Tosses Lawsuit Meant to Block President Trump From Barring Illegals in Census Count

The United States Supreme Court on Friday dismissed a lawsuit seeking to block President Trump’s plan to exclude illegal immigrants from the census count.

The count would be used to determine the number of seats states receive in the House of Representatives.

The 6-3 ruling saw the court divided along ideological lines, according to Reuters, but Chief Justice John Roberts has sided with liberals consistently over the last few years, including a case in which the President attempted to end DACA protections for illegals.

The Court, in an unsigned decision, states “judicial resolution of this dispute is premature,” in part due to the President’s executive order leaving it unclear how the administration would proceed in implementing the directive.

“The President, to be sure, has made clear his desire to exclude aliens without lawful status from the apportionment base,” the opinion reads.

“But the President qualified his directive by providing that the Secretary should gather information ‘to the extent practicable’ and that aliens should be excluded ‘to the extent feasible,” it continued.

“Any prediction of how the Executive Branch might eventually implement this general statement of policy is ‘no more than conjecture’ at this time.”

Supreme Court Punts On Lawsuit Attempting To Keep Trump From Blocking Illegals in the Census

The news from the Supreme Court is less a victory than a temporary effort to kick the can down the road on having illegals counted in the census.

Reuters referred to the opinion as a “short-term victory” and noted the administration “is battling against the clock to follow through on the vaguely defined proposal” before President-elect Joe Biden’s inauguration.

The President signed the executive order in July stating illegal immigrants would no longer be counted in the population numbers for the purposes of redrawing electoral districts.

“There used to be a time when you could proudly declare, ‘I am a citizen of the United States.’ But now, the radical left is trying to erase the existence of this concept and conceal the number of illegal aliens in our country,” the President said in a statement at the time.

“This is all part of a broader left-wing effort to erode the rights of Americans citizens, and I will not stand for it,” he added. 

If the lawsuit or any future litigation is successful in stopping this order, far-left states that accept illegal aliens and offer them sanctuary would be given greater representation in the House.

A study by the Center for Immigration Studies (CIS) shows that, of 26 seats that would be lost, 24 are from states that voted for Trump in 2016, while 19 seats would be gained in the solidly Democratic states of California, New York, New Jersey, Massachusetts, and Illinois.

ACLU Threatens to Sue On Behalf Of Illegal Immigrants Again

During an appearance with Seth Myers on his NBC late-night show, Rep. Alexandria Ocasio-Cortez (D-NY) encouraged illegal immigrants to fill out the census.

“Every single person, no matter your documentation status, no matter your housing status, income, etc., is to be counted,” she told the audience.

When President Trump first re-introduced the question of citizenship on the census, liberals were outraged calling it xenophobic.

Now they’re telling them to fill it out and filing lawsuits to make sure illegals are counted.

The ACLU has already declared that despite the Supreme Court setback, they will continue to challenge the order.

“If the administration actually tries to implement this policy, we’ll sue. Again. And we’ll win,” said Dale Ho, a lawyer for the ACLU.

Even if Roberts once again caves in siding with liberals when he’s finally forced to make a decision on this matter, Trump’s three Supreme Court nominees could still save the day.
