Whistleblower Is Willing To Submit Written Answers To House Republicans, Lawyer Says

The intelligence community whistleblower who filed a complaint against President Donald Trump is willing to answer questions from Republicans on the House Intelligence Committee in writing, his lawyer said Sunday.

The attorney, Mark Zaid, said he reached out Saturday to GOP California Rep. Devin Nunes, the ranking member of the House Intelligence Committee, to offer to provide written answers under oath to Republicans.

The proposal would allow Republicans to circumvent the intelligence panel’s Democratic majority, led by California Rep. Adam Schiff, who has unilateral power to call witnesses as part of the impeachment inquiry of Trump.

Zaid said that the whistleblower, who is reported to be a CIA analyst, will not respond to questions about his identity.

Trump and a handful of House Republicans have called for the whistleblower to be identified. Democrats and the whistleblower’s lawyers argue that the identity of the analyst is irrelevant given testimony given by other witnesses in the impeachment inquiry.

The whistleblower’s lawyers, Zaid and Andrew Bakaj, have floated vague legal threats to deter news outlets from identifying their client. They said in a statement on Oct. 31 that news outlets will be “personally liable” if the whistleblower is harmed if they are identified. Government whistleblowers are legally protected from being identified by their government agencies, but there are no laws prohibiting journalists from identifying whistleblowers.

House Republicans have questioned the whistleblower’s possible political bias and his contacts prior to filing the Trump complaint with an aide in Schiff’s office. Republicans have downplayed the whistleblower’s allegations against Trump by arguing that he did not have first-hand knowledge of the information laid out in the Aug. 12 complaint.

The whistleblower accused Trump of abusing his power in his dealings with Ukrainian President Volodymyr Zelensky. The complaint centers on a July 25 phone call in which Trump asked Zelensky to consider investigating whether Ukraine meddled in the 2016 U.S. election and whether Joe Biden pressured Ukraine to shut down an investigation in 2016 into Burisma Holdings, an energy firm that had the former vice president’s son Hunter Biden as a board member.

The whistleblower did not listen to the phone call but relayed what he said were concerns expressed by White House officials regarding the Trump-Zelensky phone call.

Schiff initially wanted to call the whistleblower to testify before Congress, but he backed away from the proposal after it was revealed that an aide in his office had contact with the whistleblower prior to him filing the Trump complaint.

The Schiff aide’s contact with the whistleblower was not revealed until Oct. 3, weeks after Schiff had mounted a pressure campaign to force the release of the complaint.

  • I totally agree with you. We have a whistleblower, filing a complaint, against the President, based on nothing but hear say, which shouldn't be allowed in any case, who is known to be an anti Trump Democrat, all of which should be red flags. He is being protected, by slimy Shitf, who we understand knew about the complaint beforehand, but lied about knowing. It's interesting that hear say was not allowed to be presented as evidence, until the House changed that law a week or two before the complaint came to light. More red flags popping up. There is no doubt in my mind that Shitf told the whistleblower, what to say, or set the whole thing up himself, being the sneaky, corrupt little weasel he is. The whistleblower must testify, facing the President, who must be allowed representation. No court of law, at least an honest one, would even try a case like this. It's nothing more than another corrupt Socialist attempt to overthrow our President, which also makes them traitors.

  • Look guy's this whisler is now groum by the Democrats, behind closed doors where they remove the nataries from his testimony, & leaving only the words they felt important & now is ready to carry out his part of the cud de tah by the Demo o Cracy, but only by letter with out his nataries. were you expecting any things else? the only way I would believe this whisler is he would have to bring Jesus Christ & his 12 disciples, & then still question his motive?

  • Not quite exactly the same, which may be unfortunate. It doesn't really matter due to the fact that there will never be a vote to remove him from office from the implications and allegations of the phone call. Democrats are loading their guns with ammunitions from the Mueller report and will introduce formal actions when they follow up with obstruction of justice allegations and here we go again. Those allegations should be of more concern, but they're keeping specifics in the dark until they use them in very calculated moves.

  • Had the department of justice and judicial committee handled this properly, they would have initiated an investigation well before declaration of a whistleblower, and most likely would have never had a need to reference a whistleblower prior to formal proceedings after indictment. Immediate disclosure of a whistleblower's existence may put a whistleblower in harm's way, especially in this situation, given the gravity of the matters. Consider a whistleblower submission of a similar circumstance if Bill Clinton, or Hillary were in Trump's shoes! I wouldn't want to be in the whistleblower's shoes, even with insurance of anonymity! The means by which this debacle was introduced and handled actually made me question if an actual whistleblower even existed in the first place. And, if the whistleblower was given the information from someone who had first hand knowledge of the context of the phone call, wouldn't it be prudent of the committee Republicans to include questioning under oath to each one of the deposed persons spoke to and who shared shared what information to another which could have been used as a complaint by a whistleblower? I would tend to believe that Steve Wilcos's polygraph expert would even know some good lines of questioning to get to the truths.....without the polygraph, but under oath in a federal venue. LOL

  • A whistleblower may demand in writing with subsequent agreement for anonymity, in similar fashion as those who are given immunity to prosecution for sharing evidence, and/or anonymous deposition during an investigation. This obligates and guarantees anonymity according to law, and there may be unique circumstances, and/or conditions included in a particular agreement.

  • A police informant is NOT a "whistleblower." QUIT trying to conflate the two in order to make a COMPLETELY invalid point.
