The Supreme Court has agreed to take up a major NRA-backed case to determine whether the Second Amendment applies outside of the home.

The Supreme Court has agreed to take up a major NRA-backed case to determine how much the Second Amendment applies outside of the home.

The case involves an appeal by a New York-based gun-rights group and two individuals who claim their rights have been infringed upon by a state law restricting the ability of residents to carry concealed handguns in public.

According to an Axios report, New York’s current handgun licensing laws restricts those carrying in public to those who can “demonstrate a special need for self-protection distinguishable from that of the general community or of persons engaged in the same profession.”

The National Rifle Association has backed the appeal.

The New York State Rifle & Pistol Association, the group involved in the appeal, would like to see the Supreme Court clarify the rights of the individual.

“There is no Second Amendment issue more pressing than whether the fundamental, individual right to self-defense is confined to the home,” the group states.

“A minority of jurisdictions seem determined to control the very people and rights that the Second Amendment promises ‘shall not be infringed.'”

Supreme Court Will Hear Major Second Amendment Case

The Supreme Court will hear the Second Amendment in the new term that begins in October.

Axios reports that a decision from the high court on the appeal “could result in the most consequential ruling related to the Second Amendment in over a decade.”

“The court has not litigated the reach of the Second Amendment since rulings in 2008 and 2010 struck down gun regulations in D.C. and Chicago,” they write.

Bloomberg notes that gun-rights advocates are hoping the three conservative justices appointed by former President Donald Trump will take a pro-Second Amendment stance on the matter.

Some conservatives are having a difficult time finding faith in those same justices holding a conservative bent when they refused to hear election integrity challenges and have, on numerous occasions, sided with the liberal wing of the court.

Major Gun Control Push Underway In Biden Era

The announcement by the Supreme Court in hearing the appeal against New York state comes as there is a major gun control push underway under President Biden.

Earlier this month, the President announced several executive orders to curb gun rights while pushing Congress to take even further action, including calling for lawmakers to consider legislation banning ‘assault weapons’ and ‘high capacity’ magazines.

Biden even proclaimed, “No amendment to the Constitution is absolute.”

In an interview over the weekend, Vice President Kamala Harris advised lawmakers of the need to pass an “assault weapons ban.”

“We should have an assault weapons ban,” declared Harris. “Assault weapons have been designed to kill a lot of people quickly.”

“They are weapons of war, and Congress has to act,” she insisted.
