SSN, Work Requirement For Child Tax Credit Would Be Removed In ‘Build Back Better’ Plan

Inside of the Biden administration’s massive ‘Build Back Better Act, a provision can be found that would ditch the Social Security number requirement for the Child Tax Credit.

This provision can be found on page 1,647 of the 2,135-page bill. It would change federal tax code by removing the requirement that a child have a valid Social Security number in order to be eligible for tax credits.

In other words, the eligibility would be expanded to possibly include illegal immigrants.

Tax Credits For Illegal Immigrants?

Of course, all of this depends on if the Democrats’ massive $1.75 trillion social spending package actually gets through Congress as is or at all.

Still, why would Democrats want to remove the SSN requirment?

The current law reads, “No credit shall be allowed under this section to a taxpayer with respect to any qualifying child unless the taxpayer includes the social security number of such child on the return of tax for the taxable year.”

If this was removed, it could potentially mean illegal immigrants now living in the U.S. could also be eligible for the credits.

According to Steven Camarota, a researcher for the Center for Immigration Studies, this provision could cost American taxpayers $2.3 billion in payouts to illegal migrant parents with children living in the U.S.

It Would Also Eliminate Work Requirement

“Illegal immigrants are able to receive benefits on behalf of their U.S.-born children,” Camarota told Fox News. “But the permanent elimination of the SSN requirement means that even illegal immigrants whose children are also illegally in the country can receive cash payments, including the roughly 600,000 unaccompanied minors and persons in family units stopped at the border in FY2021 and released.”

This bill would also eliminate the work requirement for next year, which would make payments to illegal immigrants much easier.

Camarota explained, “In the past, some illegal immigrants who worked off the books sometimes had trouble demonstrating employment income, but now that won’t be a problem.”
