A federal judge has tossed out porn star Stormy Daniels’ lawsuit against President Trump, citing First Amendment rights, and ordered her to pay his attorney fees.
Daniels sued the President in April regarding a tweet in which he denied her claims of being threatened by a man in a Las Vegas parking lot in 2011.
The adult actress claimed a man had warned her about going public with an alleged affair with Trump. She later provided a police sketch of a man many viewed as a dead ringer for her ex-husband.
Trump mocked her story as a “total con job,” prompting the lawsuit.
Judge Rules For Trump
The Los Angeles-based judge ruled that President Trump’s tweet amounted to ‘rhetorical hyperbole,’ a normal part of political discourse that is protected by the First Amendment.
“The court agrees with Mr. Trump’s argument because the tweet in question constitutes ‘rhetorical hyperbole’ normally associated with politics and public discourse in the U.S.,” U.S. District Judge S. James Otero ruled. “The First Amendment protects this type of rhetorical statement.”

Otero previously stated, “to have one consider this to be defamatory in the context it was made would have a chilling effect” on free speech.
Trump’s attorney delivered more bad news for Stormy, relaying that “the ruling also states that the President is entitled to an award of his attorneys’ fees against Stormy Daniels.”
Avenatti Gets Shredded
The President’s attorney slammed Daniels’ lawyer, Michael Avenatti, after the ruling.
“No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. (Michael) Avenatti, can truthfully characterize today’s ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels,” he gleefully stated.
Avenatti took to social media to try and save face. He said the President’s claim to victory is “as deceptive as his claims about the inauguration attendance,” and vowed to appeal the ruling.
He later deleted that tweet and issued an official statement.

Perhaps Daniels should drop these frivolous lawsuits before Avenatti puts her further into debt.
Avenatti Continues His Losing Streak
The ruling against his client keeps Avenatti on a losing streak that has affected the nation and made President Trump a two-time winner against the porn lawyer. It is perhaps a preview of an upcoming battle in 2020.
Aside from a legal victory over the creepy porn lawyer, Trump scored a huge victory with the confirmation of Supreme Court Justice Brett Kavanaugh.
Many pundits on both sides of the aisle view Avenatti’s effort to fabricate ‘gang-rape’ allegations against Kavanaugh as a catalyst, a ‘jumping the shark’ moment, for public acknowledgment of the ridiculous smear job Democrats had engaged in. His client’s claims were so outrageous, so unprovable, and so contradictory every time she spoke, that it cast doubt on all of the other already specious claims against the judge.
It may be inadvertent, but Avenatti is helping President Trump make America great again by giving him such easy wins over the hapless attorney. America isn’t tired of winning, especially when it comes at the expense of a porn star and her lawyer.
