Hillary Clinton Says America In ‘Constitutional Crisis,’ Wants To End The Filibuster

On Thursday, former Secretary of State Hillary Clinton once again voiced support for ending the filibuster and accused Republicans of not respecting the rule of law.

Clinton’s claims stem from then-Senate Majority Leader Mitch McConnell not rubber-stamping Barack Obama’s pick for the Supreme Court, Merrick Garland.

Clinton made her remarks during an interview at The Atlantic Festival’s Ideas Stage.

Clinton Wants To End The Filibuster

Clinton emphatically said that she would “absolutely” support ditching the filibuster, citing Senate Republicans’ not allowing a vote on Garland’s nomination.

Clinton said, “Keeping the filibuster now, when you’re dealing with a political party that does not respect the rule of law, does not even respect the process unless it works for them — you know, witness what they did to Merrick Garland when President Obama had every right to appoint a Supreme Court justice.”

There is no law stating that the Senate must approve – or even vote on – a Supreme Court nomination. 

The former first lady also said that America is “in the middle of a constitutional crisis.”

Clinton observed, “People are still arguing about stuff that is important but not as fundamental as whether or not our democracy will be broken, and then taken over and minority rule will be what we live under.”

The filibuster rule basically means in practice that for most pieces of legislation to move forward in the U.S. Senate for a final vote, that bill must get 60 votes. 

When Democrats were toying with the idea of scrapping the filibuster in March, Clinton supported that effort.

Clinton said the filibuster should be eliminated due to “constitutional matters.”

Clinton In March: ‘The Filibuster Stands In The Way Of A Lot Of Legislation’

At the time, Clinton told host and former aide Jennifer Palmieri on her show the Just Something About Her podcast, that repealing the filibuster would allow the Senate to pass voting rights legislation.

“The filibuster stands in the way of a lot of legislation and whether or not it can be either reformed and amended or eliminated is what we will find out in next weeks,” Clinton said.

“It certainly should be lifted for constitutional matters, and I would put election law matters at the top of that list,” Clinton added.
