On Monday, Arizona Attorney General Mark Brnovich announced that his office is suing the federal government over immigration decisions and preparing action against the president’s gun control proposals.
Brnovich’s press release stated that has filed a lawsuit against the US Department of Homeland Security and other federal officials for violating the National Environmental Policy Act (NEPA) with their immigration polices.
We just filed a lawsuit alleging the Biden Administration illegally halted construction of the border wall and improperly rescinded the "Remain In Mexico" policy. The border crisis is out of control. We will not sit idly by as harms are done to our state. https://t.co/eEndIjns2Q

AG Brnovich: ‘The Border Crisis Is Out Of Control’
Arizona is contending that the NEPA recognizes population growth as a significant environmental impact, and as such recent immigration policies may run afoul.
“We just filed a lawsuit alleging the Biden Administration illegally halted construction of the border wall and improperly rescinded the ‘Remain In Mexico’ policy,” Brnovich tweeted.
“The border crisis is out of control. We will not sit idly by as harms are done to our state.”
Brnovich has also asked the US District Court in Arizona to “void the decisions to stop border wall construction” and to make sure the “Remain in Mexico” policy remains in place until the federal government complies with the NEPA.
“It’s the pinnacle of hypocrisy for the Biden Administration to claim it wants to protect our environment, while not enforcing federal statutes that are specifically designed for that purpose,” said Attorney General Mark Brnovich.
“We’re not going to sit idly by as the Biden Administration ignores real harms to our state resulting from its heavy-handed executive orders,” he added.

Undoubtedly, it’s a novel approach from a Republican state to argue on grounds of the environment.
In terms of gun control, Brnovich told Fox News’ Maria Bartiromo that his office is currently in the process of working on “comments” to Biden’s newly-announced gun rules.
Texas Will Also Fight Biden Gun Policies
Arizona isn’t the only state to pushback on federal policy.
On Sunday, Texas Gov. Greg Abbott criticized Biden over his upcoming executive actions regarding gun regulation.
Abbott told Fox News, “[I]f the president wanted to do something more than show … if the president really wanted to do something substantively, what he really could do by executive order is to eliminate the backlog of complaints that have already been filed about gun crimes that have taken place.”

The governor continued, “I think that there is no acceptable way that a president by executive order can infringe upon Second Amendment rights or alter Second Amendment rights.”
Abbott said Americans and Texans in particular understand the importance of the Second Amendment.
“Texans and Americans know they need their Second Amendment rights to defend themselves at a time when the United States government and other governments are doing less to defend our fellow Americans, and that is exactly why we should not have any further limitations of our Second Amendment rights,” he added.
Last week, Governor Abbott vowed to make Texas a “Second Amendment Sanctuary State” to thwart the new gun control efforts.
It’s unclear yet what form Texas’ effort will take.
