Constitutional law expert and former chief of staff to Attorney General Edwin Meese, Mark Levin, has dropped a bombshell, alleging that Robert Mueller’s investigation of President Trump is unconstitutional.
Politico reported on Monday that several lawyers from Mueller’s office obtained an obscure “special status” involving the case against former Trump campaign chairman Paul Manafort.
Court documents show those lawyers not only appeared in federal court as members of Mueller’s team but also as special assistant United States Attorneys (SAUSAs).
Levin explained that such designation makes Mueller, as their supervisor, a “roving” U.S. Attorney, and by law, the President should have been the one to nominate all “principal officers” – including U.S. attorneys.
Instead, Mueller was appointed by Deputy Attorney General Rod Rosenstein, was not confirmed by the Senate, and thus “violates the Constitution (via) the Appointments Clause” in Article II.
I agree with Professor Calabresi; Mueller’s appointment by Rosenstein violates the appointments clause of the Constitution. Please listen to this … https://t.co/Fuu0bq1Bq4

“Rosenstein usurped the authority of the president of the United States to nominate whoever he wants as a prosecutor,” Levin alleged.
“Mr. Mueller is serving unconstitutionally in violation of the Appointments Clause of the U.S. Constitution because of the way Rod Rosenstein appointed him.”

Levin followed up on his radio program indicating reports prove “at least four of the individuals who report to (Mueller) are effectively assistant U.S. attorneys.”
He said that revelation is “the icing on the cake” in proving the entire probe under Mueller is unconstitutional. (RELATED: Trey Gowdy Is Furious at Robert Mueller’s Embarrassing Investigation – Calls Probe ‘Embarrassing’).
Levin urged every defendant in the probe and all attorneys for those subpoenaed in cases involving his investigation to raise the issue of the Appointments Clause in court.
President Trump, meanwhile, continues to rail against the Mueller probe as an outright “witch hunt.”
WITCH HUNT!

Vice President Mike Pence urged Mueller to finally end the ridiculously long investigation that has thus far only turned up minor charges against bit players in the Trump campaign.
“Our administration has provided more than a million documents; we’ve fully cooperated in it, and in the interest of the country, I think it’s time to wrap it up,” Pence said.
Now, Levin has revealed that the probe is not only a witch hunt, it violates Constitutional law.
It needs to end.
