N.C. Legislator Demands Secretary of State Resign for Giving Notary Licenses to Illegals

Throughout the 2016 presidential campaign, then-candidate Donald J. Trump made illegal immigration one of the focal points of his improbable victory. Trump pledged to enforce America’s immigration laws, build a border wall along the U.S.-Mexico border, and eliminate sanctuary cities.

One state that has been hit especially hard by illegal immigration, which Donald Trump unsurprisingly won, is North Carolina. The Tar Heel State is listed as having one of the largest illegal immigrant populations in the nation, and Donald Trump spoke directly to those voters who had been harmed by the uncontrolled influx into their state.

While Donald Trump easily defeated Hillary Clinton in North Carolina, one Democrat is trying to hinder his crackdown on illegal immigration, but Republicans are having none of it.

Elaine Marshall, who has served as North Carolina’s Secretary of State since 1997, has “commissioned 320 individuals as notaries who are not either legal permanent residents or citizens.”

One legislator, Republican state Representative Chris Mills is now calling on Marshall to resign, given that she has violated state law by giving illegal immigrants the power to be notaries public.

The legislator received records from the North Carolina secretary of state’s office which showed 250 illegal immigrants who received amnesty have become notaries public. Another 72 other immigrants who have become notaries public are not permanent resident aliens. Marshall’s office also gave Millis a document which stated that one alien who received a license is under a final order of deportation[.]

The Republican legislator said in a Monday letter to Marshall, “It is clear that you have commissioned to many types of aliens (including illegal aliens) the authority as notaries public over the last nine years.”

Millis added, “you and your office granted notary commissions to these aliens in conflict with the letter and the spirit of North Carolina law and United State law.”

She and her office have previously defended themselves by saying that they can accept a work authorization as sole proof of legal residence. “The Attorney General of this state has issued an opinion that we are doing is correct,” Marshall said in an interview October. “We have not, we are not issuing commissions to illegal aliens,” the secretary of state said, adding, “We don’t have a DACA card in the file.”

All of three of these statements however are false. An attorney with the North Carolina Attorney General’s office did put out an “advisory letter,” but it contained a caveat which said it had “been reviewed and approved in accordance with the procedures for issuing an official Attorney General’s opinion.”

North Carolina’s Governor is a Democrat, Roy Cooper, and it is unlikely that he will call for a member of his own party to resign. However if it is confirmed that she knowingly violated state law, she must face justice.

The state and its officers have an obligation to put the safety and priority of its citizens first. If an elected official, in this case the North Carolina Secretary of State, is violating her oath of office by failing to uphold state law, then she cannot in good conscience remain in office.
