Trump Wins Major Victory on the Wall from the Supreme Court

The administration can use $2.5 billion from Pentagon funding to secure the country on the southern border, the high court declared on Friday

Many in the Trump administration must be all smiles on this summer Friday evening.

That’s because, late on Friday, the Supreme Court took the side of the Trump administration on a key issue.

It removed restrictions put in place by a lower court, which had stopped the administration’s plans to use Pentagon funds to the tune of $2.5 billion to build a barrier wall on the southern border between the U.S. and Mexico.

“The decision, split along ideological lines, allows the administration to move ahead with plans to use military funds to replace existing fencing in California, Arizona and New Mexico with more robust fencing,” as Fox News explained.

Conservative justices ruled in favor of the administration.

The liberal justices who dissented were Elena Kagan, Ruth Bader Ginsburg, and Sonia Sotomayor.

And Justice Stephen Breyer was split on the isuse — he said he would approve the transfer of funds, yet would not have construction of the wall begin at this time.

The president declared on Twitter at about 6:30 p.m. on Friday evening, “Wow! Big VICTORY on the Wall. The United States Supreme Court overturns lower court injunction, allows Southern Border Wall to proceed. Big WIN for Border Security and the Rule of Law!”

“The ruling means the Trump administration can tap the funds and begin work on four contracts it has awarded,” as Fox also noted.

Here’s more of that explanation: “A trial court initially froze the funds in May and an appeals court kept that freeze in place earlier this month. The Trump administration had asked the Supreme Court to take up the issue.”

“Earlier this month, a divided three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco agreed with a lower court ruling that prevented the government from tapping Defense Department counter-drug money to build high-priority sections of the planned wall in Arizona, California, and New Mexico.”

In February of this year, Trump declared a national emergency along the southern border — while preparing to sign a budget deal that fell far short of his requests.

“We’re talking about an invasion of our country, with drugs and human traffickers, with all types of criminals and gangs,” said Trump.

Trump’s fierce battle for funding for the border wall and many lawmakers’ resistance to his plans led to a partial government shutdown of 35 days — and threatened another one.

But since he was dissatisfied with the border security investments, Trump also moved to declare a state of emergency to free up more funds. “The order is signed and I’ll sign the final papers once I get back to the Oval Office,” Trump said during a press conference at the White House in February.

“I’m going to be signing a national emergency and it has been signed many times before,” Trump also said. “There has rarely been a problem. They sign it and nobody cares. I guess they weren’t very exciting. But nobody cares and they sign it for far less important things in some cases, in many cases. We’re talking about an invasion of our country with drugs and human traffickers, with all types of criminals and gangs.”
