The Obama administration is actively attempting to grant the federal government warrantless access to your web browsing histories and other metadata.
The Judiciary Committee will be considering an amendment to the Electronic Communications Privacy Act (ECPA) this week, allowing the FBI to subpoena records associated with Americans’ online communications. The amendment would grant the feds access to phone logs, email records, cell-site data used to pinpoint locations, as well as a list of visited websites.
All without the need for court approval.
Judge Andrew Napolitano responded to the change in law by saying it “will pass because the Congress doesn’t give a damn about whether it’s unconstitutional!”
And he was just getting fired up.
“The American people should wake up,” Napolitano pleaded. “This is a major step toward a police state.”
He argued that lawmakers view the Constitution as a stumbling block to getting what they want, but that our Founding Fathers made it that way intentionally.
“Guess what?” he asked. “The Constitution is intentionally a pain in the neck so that law enforcement will not run roughshod over our civil liberties!”

Lawmakers are considering proposed legislation this week that would grant the FBI that uninhibited access. Critics, including Google and Facebook, have argued such changes would be a violation of Americans’ privacy. But, in Napolitano’s view, elected officials will argue under the “facade” that it is necessary for the population’s safety.
Ultimately, he concluded Congress will pass the legislation.
“This law will pass because the Congress doesn’t give a damn about whether it’s unconstitutional,” Napolitano charged. “[T]he American people should wake up. … This is a major step toward a police state.”
Backing up his argument, Napolitano noted that FBI Director James Comey has suggested that the Constitution encumbers investigations, making the agency’s work all the more difficult.
“Guess what. The Constitution is intentionally a pain in the neck so that law enforcement will not run roughshod over our civil liberties,” the Fox News senior analyst told network host Shepherd Smith.
“No matter which party controls the Congress,” Smith added, “it’s always done in the name of keeping us safe.”
He concluded, “Who, or what, will keep our liberties safe?”
