A 2011 sexual assault case against Mark Cuban has resurfaced following the release of police records of the investigation, and things aren’t looking good for the billionaire businessman and Hillary Clinton surrogate.
As reported by Willamette Week, Cuban was accused of sliding his hand down the back of a woman’s pants while they posed for a photo together at the Barrel Room bar in Portland in 2011. The woman, who is now married and in her 30s, reported the alleged incident to police two weeks later.
A detective’s summary of the woman’s victim statement is extremely graphic and disturbing:
“He then moved his hand down until it was on her buttocks.
“Cuban then pushed his hand down the back of her jeans and inside her underwear where he cupped his hand over her groin area…”
The woman included seven photographs with her complaint. According to the police report, she appears visibly uncomfortable in one of the photos. “Her teeth are clenched, eyes wider than the other pictures and brow raised showing a look of surprise and strain.”
Cuban categorically denied the allegations, and the charges against him were eventually dropped due to lack of evidence. However, the transcript of Cuban’s phone call with Detective Brendan McGuire on June 8, 2011 clearly indicates that Cuban was panicked:
“Oh my Lord. Oh my f**king Lord. Oh, that’s what you get for being nice,” he told the officer after hearing the claims. “I put my finger in her vagina?! Are you kidding me?
“Unbelievable. I’m damned if I do and damned if I don’t. I’m just gonna be like a pariah no matter what,” he continued, after denying the allegations. “Nothing happened, but when you’re high profile, it doesn’t, it’s never just about nothing happening.”
Cuban added, “There was no way to prove the truth… Oh Lordy. F**k me! I’m so f**ked”
The question is: was Cuban’s reaction that of a guilty conscience or incredulous innocence?
Whatever the case, a witness to the alleged incident has come forward. Security worker Christopher White told The Oregonian that he was present at Barrel Room on the night of the incident, and claims he saw Cuban’s interaction with the woman. “She jumped away like she was not happy with him,” White said. “That’s when the energy in the room kind of exploded.” He also claims that Cuban acted “gropey” toward women at the bar and was so inebriated that he was eventually asked to leave.
Cuban continues to deny that he assaulted the woman.
