Federal Judge William Alsup, a Bill Clinton appointee, has ordered the Trump Administration to maintain the illegally implemented Deferred Action for Childhood Arrivals (DACA) program.
The program grants amnesty to over 700,000 illegal immigrants. DACA was implemented via executive directive under President Obama in 2012, allowing certain people, known as Dreamers, who came to the U.S. illegally as children, to be protected from immediate deportation.
Alsup granted the stay at the request of California and other plaintiffs who currently have lawsuits pending.

Once again, California activists demonstrate that their state is spearheading the movement to normalize illegal and unlawful actions.
Judge Alsup claims lawyers supportive of DACA clearly demonstrated that the illegal immigrants “were likely to suffer serious, irreparable harm” without court action.
Huh. You have to wonder if this judge would have considered somebody like Kate Steinle to have ‘suffered serious, irreparable harm’ at the hand of an illegal immigrant.
President Trump ended the program last year, giving Congress until March to fix that which was illegally implemented.

The judge’s decision comes on the heels of an “extraordinary” meeting of lawmakers on immigration reform, that the President opened to the press.
Trump promised to sign a “bill of love” to extend protections for those illegal immigrants who entered the country as children.

A Justice Department official vowed to fight the ruling, but if a fix is implemented during border security negotiations, there would be no need.
“Tonight’s order doesn’t change the Department of Justice’s position on the facts: DACA was implemented unilaterally after Congress declined to extend these benefits to this same group of illegal aliens,” said Justice Department spokesman Devin O’Malley.
“The Justice Department will continue to vigorously defend this position, and looks forward to vindicating its position in further litigation,” he added.
Pro-amnesty advocates are celebrating the judge’s ruling as a victory against Trump. But is it? Especially when he’s currently trying to negotiate a deal to keep DACA?

President Trump responded to the judge’s ruling early this morning:
It just shows everyone how broken and unfair our Court System is when the opposing side in a case (such as DACA) always runs to the 9th Circuit and almost always wins before being reversed by higher courts.

The Administration can appeal the decision to the 9th Circus Court of Appeals. The order does not require new DACA applications to be processed, and those already on the books that law enforcement view as a threat to national security may still be removed.
