Remember the Freddie Gray case, and the witch hunt conducted by an overeager prosecutor that followed?
The Baltimore police officers, who were wrongfully charged with offenses ranging from second-degree murder to manslaughter, reckless endangerment, and misconduct in office in that case, just got some good news.
Their lawsuit against Baltimore Prosecutor Marilyn Mosby, according to a federal judge, can move forward.
The officers had accused Mosby of false arrest, false defamation, and imprisonment, among other misdeeds.
America’s favorite sheriff, David Clarke, explained that the battle between officers who were maliciously charged and the prosecutor who pursued them isn’t over by a long shot.

A federal judge has ruled that key parts of a lawsuit against Baltimore City State’s Attorney Marilyn J. Mosby, filed by five of the six officers charged in the death of Freddie Gray, can move forward.
“U.S. District Judge Marvin J. Garbis ruled that claims including malicious prosecution, defamation, and invasion of privacy can move forward against Mosby and Assistant Sheriff Samuel Cogen, who wrote the statement of probable cause,” the Baltimore Sun reports.
Although Mosby’s attorneys said she had immunity from prosecution for actions taken as a state’s attorney, Garbis noted that her office had said it conducted an independent investigation.
“Plaintiffs’ malicious prosecution claims relate to her actions when functioning as an investigator and not as a prosecutor,” Garbis wrote.

If you recall, three of the six officers charged in connection with Gray’s death were found not guilty on all charges, while prosecutors dropped charges against the other three last summer.
This lawsuit now allows the tables to be turned, as an attorney for one officer said that “the ruling means the officers’ attorneys will begin the discovery stage, which includes deposing Mosby and others involved in the investigation.”

Now it’s time for Mosby to face scrutiny. Only difference being, unlike the police officers in this case, she actually deserves it.
