AOC, Liberals Want Supreme Court Justice Stephen Breyer To Retire So Biden Can Nominate New Judge

On Sunday, Democratic Congresswoman Alexandria Ocasio-Cortez said that she believed Supreme Court Associate Justice Stephen Breyer should retire at the end of the court’s term so that President Joe Biden could nominate his successor.

Ocasio-Cortez made her comments during an interview on CNN’s “State of the Union.”

Bash To AOC: ‘Do You Think Justice Breyer Should Step Down?’

CNN anchor Dana Bash said to AOC, “I want to ask about the Supreme Court. They are poised to hear several blockbuster cases in the next term voting rights, gun control, abortion.”

“Your fellow Democrat Mondaire Jones says Justice Breyer should retire so President Biden can fill his seat with a younger liberal successor,” Bash continued.

Bash then asked the Democrat, “Do you think Justice Breyer should step down?”

Ocasio-Cortez said, “We have had very difficult experiences with making I believe the opposite mistake, and especially if Senate Democrats are not going to pass reforms on HR 1, we cannot rely solely on a wish of winning elections, particularly in the Senate when voting rights are under attack in Georgia, Arizona and Texas across the country.”

AOC: ‘I Would Probably Lean Towards Yes’

“And if we’re not going to pass HR 1 with the preemptive clauses that can roll some of that voter suppression attacks back, yeah, I believe that we should protect our Supreme Court, and I bet that should absolutely be a consideration,” Ocasio-Cortez said, referring to the Democrats ‘For The People’ federal elections legislation.

Bash then asked AOC to clarify her remarks.

“Just to be clear,” Bash said, “you do think that Justice Stephen Breyer should retire at the end of this term?”

Ocasio-Cortez replied, “You know I, it’s something that I’d think about, but I, I would probably lean towards yes.”

Breyer Is The Oldest Member Of The Supreme Court

“But yes, you’re asking me this question, so I’ve just, I would give more thought to it but, but I’m inclined to say yes,” Ocasio-Cortez told Bash.

Justice Stephen Breyer is 82-years-old and is the oldest member of the Supreme Court. Breyer was appointed by President Bill Clinton in 1994.

NPR reported back in May that liberals want Breyer to retire from the Court, citing figures such as Rep. Mondaire Jones, Sen. Richard Blumenthal, and Women’s March executive director Rachel Carmona.

“But as Congress has grown more ideologically polarized — and after bitter Obama- and Trump-era battles over Supreme Court seats — those confirmations have become much narrower.

That is why many on the left are hoping that, after nearly three decades on the high court, Breyer has his eye on the exit.”
