Alan Dershowitz: Swetnick Affidavit Is ‘An Embarrassment To The Law’

Harvard law professor emeritus Alan Dershowitz ripped apart Julie Swetnick’s allegation against Supreme Court nominee Brett Kavanaugh Wednesday night, deeming her sworn affidavit “an embarrassment to the law.”

Speaking with Fox News’s Tucker Carlson, Dershowitz said there needs to be a cross-examination of Swetnick, who claimed in a sworn affidavit Wednesday that Kavanaugh and classmate Mark Judge spiked girls’ drinks to facilitate gang rape at a number of house parties in the early 1980s. She also claimed that she was raped at one of the parties – but not by Kavanaugh or Judge.

“That affidavit is so deeply flawed and so open-ended that any good lawyer, any good defense attorney would be able to tear that apart in 30 seconds,” Dershowitz said. “It’s an embarrassment to the law that anybody would file an affidavit like that filled with hearsay.”

Indeed, the affidavit is an absolute embarrassment to the law. But given that Swetnick’s attorney is Michael Avenatti, should we have expected anything less?

Dershowitz then went on to take a subtle swipe at Swetnick herself, pointing out that she kept attending the parties despite allegedly knowing that girls were being drugged and raped. “(The affidavit is) filled with, ‘Well, I was raped, but he didn’t rape me. He was there. He saw it. Where was he? There are witnesses. people told me. It happened ten times. I went back, I knew there were rapes going on but I went back to the party.'”

Liberal feminists will undoubtedly accuse Swetnick’s critics of “victim blaming,” but the fact of the matter is that her affidavit is vague, questionable, and doesn’t have a legal leg to stand on.

Further, it was released too late to have any real bearing on Kavanaugh’s Thursday morning confirmation hearing, so what was the point in releasing it at all? To get Avenatti’s name in the news again? To bolster his 2020 presidential aspirations? Or perhaps Swetnick – who has ties to Christine Blasey Ford’s attorney, Debra Katz – did it in hopes of getting a nice chunk of change to right her financial situation?

Whatever the case, Swetnick’s affidavit reads as anything but honest, and it should be completely ignored.
