It’s infuriating to read yet another story about another waste of DNA being released from jail without bail, resulting in the murder of another cop. This time it happened in Alabama—but, once again, it didn’t have to happen.
Units from the Warrior Police Department were pursuing a suspect fleeing in a vehicle. Officers from the Kimberly Police Department joined in, including 33-year-old Kimberly K-9 Police Officer Nick O’Rear.
During the pursuit, the suspect fired multiple shots, striking Officer O’Rear in the head. Firefighters transported the critically injured officer to the University of Alabama at Birmingham Hospital where he succumbed to his wounds.
According to the North Jefferson News, the suspected cop-killer’s long criminal history includes drug distribution, receiving stolen property, auto theft, and possessing a firearm illegally. The gun violation occurred just last October 31, 2019.
Cullman County Sheriff Matt Gentry said the suspect “has a history of encounters with local law enforcement.” As a retired cop, allow me to translate so there’s no misunderstanding. By encounters, the sheriff doesn’t mean the suspect bought officers cups of coffee at the local cop hangout. No, Sheriff Gentry said his deputies have arrested the suspect many times.
The North Jefferson News quoted Sheriff Gentry: “Our investigators worked tirelessly back in November alongside law enforcement in Winston County to arrest this suspect, when they recovered a stolen vehicle and firearms, along with methamphetamine.” So, with these alleged crimes, including illegal firearms possession, how was the misuse of flesh and bones out of jail to commit such a heinous act?
Law Enforcement Today explained, though the suspect was ordered held without bond, the anti-law and order leftist’s newest shiny object, “no cash bail,” reared its ugly head. Apparently, District Court Judge Madeline Haikala handed down a federal injunction “that mandated all bond-eligible inmates had to be released without bond.” Because of the order, the suspect (who would murder a police officer less than four months later) “was released the same day.”
Judge Madeline Haikala is a Barack H. Obama appointee. No surprise there. Still, to be fair, the U.S. Senate approved her nomination, voting 90-0 to confirm her. Republican senators don’t stand in the way of presidential judicial nominations like the Democrat senators do. Maybe they should have.
The alleged cop-killer has racked up six felony convictions including illegal possession of a firearm, what we in the biz call VUFA (Violation of Uniform Firearms Act). You know, one of those “commonsense gun laws” gun control advocates are always saying we need to legislate. Well, it has been legislated—many, many years ago. It’s just that too many leftists in the criminal justice system refuse to enforce it.
Here’s the formula: Leftists in the criminal justice system refuse to enforce firearms laws aimed at criminals that are already on the books. Instead, they release the criminals who’ve violated gun laws back onto the streets. Then when those criminals commit more crimes with a gun, leftists in the criminal justice system scream for more “commonsense” gun laws. Then, once again, they kick the criminal back out the revolving door to commit more crimes with guns. And the cycle starts all over again.
Despite all these reasons to keep this suspect locked up, a young cop with two children and a wife pregnant with child number three, did not go home to them. Officer Nick O’Rear did not go home to his family that night because a scumbag criminal with a long criminal history allegedly killed him. That murder is on the criminal. But he was able to kill Officer O’Rear, depriving a family of their husband and father, because Judge Haikala’s decision set him free. That’s on the judge.
As I alluded to above, the left is consistently calling for more “commonsense gun laws.” What is this disconnect where they call for these laws while so often refusing to enforce gun laws already on the books, calling the laws racist? They obviously don’t want to stop criminals using guns illegally; they do want to stop law-abiding gun owners from using guns legally.

Not even four months earlier the suspected cop-killer was arrested for being a felon in possession of an AR-15 rifle, what the ignorant gun control advocates refer to as a dreaded “assault rifle.” But a presumed anti-gun, leftist judge’s ruling frees a career criminal from jail, without bail, after he’s been arrested for multiple offenses, including illegal possession of a firearm.
Hopefully, Alabama authorities will remedy that federal court judge’s error and pursue the death penalty, and if convicted, carry it out quickly. Then he will no longer be a threat to other cops who deserve to go home to their families…like Officer O’Rear deserved to go home to his wife, two children, and the baby on the way who will never meet daddy.
